The motion by the Colorado State Public Defender to dismiss this appeal is granted. We feel we should make a few remarks to supplement this order. In 1975 the defendant was found not guilty of first-degree murder by a jury. The then district attorney appealed alleged errors of law under section 16-12-102, C.R.S. 1973 to the Colorado Court of Appeals. We accepted jurisdiction of the matter. After the matter was at issue, the motion to dismiss was filed.
